After Prime Minister KP Sharma Oli said that the government would seek to vacate of the Supreme Court's decision, which prohibits the construction of structures up to 40 metres from the riverbanks in Kathmandu, there is speculation whether the SC would review the decision.
Earlier, the SC vacated an interim order on the retirement provisions of police officers.
However, the latest verdict is different as it is related not only to a few individuals but to the entire valley and the cultural heritages. It is also important because the Supreme Court took nine months to prepare the full text of the verdict.
The law prohibiting the construction by encroaching on the land of rivers was already there and the SC had only reminded the laws when the practice of encroaching the rivers increased in the valley.
The verdict was truly against those who made money by capturing and selling the lands previously occupied by the rivers. Hence, the land mafia and land brokers are affected the most by the verdict, and if the SC vacated it only at the request of the government, there is a fear that the SC could lose its reputation.
Moreover, the members of the struggle committee and those affiliated with the UML have even demanded impeachment against two Supreme Court Justices-Anannda Mohan Bhattarai and Binod Sharma. And if the SC vacates the order, the two Justices would be proved wrong. As such, it looks unlikely that the SC will vacate the verdict.
Following the court’s decision, the Kathmandu Metropolitan City issued a notice on August 8, prohibiting the construction of structures up to an additional 20 metres from Bagmati and Bishnumati rivers and its tributaries.
