The interim order of the Supreme Court not to implement the decision to form an inquiry committee which had automatically suspended Governor of the Nepal Rastra Bank (NRB) Maha Prasad Adhikari has come as a big blow to the Deuba-led government.
The Supreme Court on Tuesday issued an interim order in the name of the Prime Minister's Office asking the latter not to implement the decision to form an inquiry committee which had automatically suspended Governor Adhikari.
With the order, Adhikari resumed his office from Wednesday, as in its order, the SC had said that the governor should be allowed to perform his responsibility.
It also said that the committee formed to conduct an investigation into Governor Adhikari was against the law.
With the interim order issued by the single bench of Justice Hari Phuyal that paved the way for Adhikari to resume his duties has exerted pressure on the government, especially on Finance Minister Sharma. Sharma, who has already used harsh words against the governor, would not receive cooperation from the central bank, should have stepped down.
Moreover, the SC verdict clearly said that suspension of the governor was against the law and Prime Minister Sher Bahadur Deuba should be held responsible for breaching the law, because the governor was suspended though a Cabinet decision on the recommendation of Minister Sharma.
Mahesh Acharya had resigned from the post of Finance Minister after the SC reinstated Tilak Rawal as the governor in 2000. However, Sharma and even PM Deuba, are not likely to follow the suit because both of them have poor moral track in politics.
The reinstatement of Adhikari has come as the impeachment motion registered against Chief Justice Sushila Karki in 2017 for Deuba. The impeachment against Karki was one of the causes for the humiliating defeat of NC in 2017 polls. This time too Deuba repeated the same mistake by removing Governor Adhikari unlawfully. Powerful leaders in the party have already questioned PM Deuba about the suspension of the governor. As such, Deuba needs to defend his step which can affect the election outcome.
Moreover, when the Finance Minister and the Governor are not in good terms, government programmes will be affected. As such, it will be better if Sharma himself steps down or the PM sacks him. FM Sharma has, of course, failed to lead the Finance Ministry when the national economy is not in good health.
The government had formed an inquiry committee on the governor on April 8.
