CJ Cholendra S Rana is fighting against the Bar officials and the entire SC judges. Bar Association and CS judges have performed non-cooperation to CJ Rana. They are putting pressure on Rana to tender resignation. As Rana is taking the stance for not tendering resignation, instead, he is ready to face impeachment in Parliament.
So far, a big section of the lawyers is of the view that CJ Rana should not quit the post under pressure from the judges and a group of layers in the Bar Association. However, the mainstream media is running behind CJ Rana. They are cornering the reports in favour of CJ Rana.
Rana himself is not a good judge, nevertheless, the Bar members and also the other judges are not out of controversy. Rana’s ousting is not a permanent solution in the court, which has become a venue for corruption and setting.
Since the practice of assigning judges based on political belief was started, the concept of an independent judiciary was ended.
The political parties in the alliance government have remained silent on the present dispute in the SC. The political leaders are looking after their interests. The political leaders are not interested to file an impeachment case against CJ Rana. The only legal and constitutional option to remove Rana is impeachment against him.
Nevertheless, it is believed that Rana alone cannot fight the war and finally, he will be compelled to tender resignation. In the meantime, a large section of intellectuals has remarked that if Rana has the courage, he should not tender resignation under the pressure from those groups having vested interests. He should face impeachment in the House and disclose all the wrong practices taking place in the Court.
Who destroyed the SC?:
The separation of power among the executive, legislator and judiciary is important in the functioning of a political system.
When Girija Prasad Koirala became the prime minister in 1991, he assigned Bishwanath Upadhaya as the chief justice by removing Dhanendra Bahadur Singh earlier to his retirement period.
In fact, Koirala is responsible for not only destroying the judiciary but the civil service, Nepal Police, all the government undertakings including the Royal Nepal Airlines.
Koirala is responsible for introducing rampant corruption in all sectors.
Later, his successors from different political parties followed the path introduced by Koirala. Since the assignment of Upadhaya as the chief justice, the concept of the independent court was ended permanently. As result, the present crisis and deadlock are witnessed in the court. All the leaders in different political parties, who started to assign judges based on the party's quota, are equally responsible for the development of such a scenario in the court.
Those retired judges who are issuing statements against Rana and demanding impeachment have also contributed to destroying the judiciary. Kalyan Shrestha, known to be the most corrupt CJ, opened the door to the European INGOs in the court.
Sushila Karki, who is making big talks, is a very controversial lady. She had to face impeachment during her tenure. She was rescued by Cholendra Shumsher Rana.
Purifying the Court:
If the political leaders are keen to purify the judiciary, they should stop intervention in the court. Accordingly, all the judges appointed through the political quota should be dismissed. If not, the five judges in the constitutional bench who gave the controversial verdict for restoration of parliament along with assigning Deuba as the PM should be relieved. Otherwise, the court will face the present situation in the days to come also.
Government under pressure to adopt MCC

Prime Minister Sher Bahadur Deuba had to face questions from the MCC officials during his presence at the climate summit in Glasgow, UK. The American officials had questioned him that why the House session was ended without endorsing MCC.
Upon his return from Glasgow, at the TIA, Deuba had informed the press that he and Maoist Center chair Prachanda had written a joint letter to MCC for its endorsement.
Later, Prachanda refuted Deuba’s statement. He said that they had requested to give four months to endorse MCC from Parliament. The time is going to expire soon, yet, there is no sign of endorsement of the MCC without an amendment on it.
Assistant Secretary of State for South and Central Asian Affairs Donald Lu will travel to Malé, Maldives and Kathmandu, Nepal. Assistant Secretary Lu will arrive in Malé on 15 November for meetings with Minister of State for Foreign Affairs Ahmed Khaleel, other senior government officials, and civil society leaders. He will be visiting Kathmandu on 17 November for meetings with Prime Minister Sher Bahadur Deuba and government leaders. By the time of publishing this newspaper, the senior American officials will already be in Kathmandu.
It is a clear indication that the Deuba government will face fresh pressure from the senior American officials for adopting MCC immediately.
Deuba is keen to endorse MCC earliest as possible, whereas, Madhav Nepal and Pushpakamal Dahal Prachanda are taking a stance for some amendments on MCC, an American grant project.
MCC may affect the present alliance if the communist leaders continue to create obstacles.
The majority of the Nepali population, former bureaucrats and intellectuals are against MCC endorsement.
On the other hand, UML chair K.P. Sharma Oli, when he was the prime minister, had attempted to endorse the MCC grant project from the House of Representatives. Presently, he has maintained silence on the issue. Oli has stated that the party will make clear about MCC after the parties in the government will make clear their decision.
If MCC is discarded by the communist parties in the government, PM Deuba may turn towards Oli for UML's support. In fact, when Oli was in the government, he had held talks with Deuba for endorsement of the American grant project. Later, when Oli had dissolved the House of Representatives for the first time, he had said to his close colleagues that he had already held a meeting with Deuba and if the House was restored by the Supreme Court, then he would run the government with the support of Deuba.
It is said that on the issue of MCC, the present alliance government may face an accident. Some observers even predict an alliance between the NC and UML.
